Global Gastronomy Tourism Organization1. Acceptance of the Terms
Use of this website entails acceptance of these Terms. Submission of a membership application entails their acceptance together with the Privacy Policy and the declaration signed within the application form.
Where a user does not accept these Terms, the user must refrain from using the website.
2. Nature of the Service
WHO is WHO is a professional directory of gastronomy tourism, published in printed and digital editions and promoted by the Global Gastronomy Tourism Organization. The website presents the Directory, hosts the membership application and provides access to the members' area.
The service consists of the publication of professional profiles. It does not comprise the provision of professional services, the intermediation of commercial relations between members, or the certification of any qualification.
3. Access by Invitation
The Directory is not open to public registration. An application may be submitted solely by the holder of a personal invitation, valid for a limited period and capable of being used on one occasion only.
Invitations are not transferable; a link forwarded to a third party confers no entitlement upon that person to apply. Submission of an application confers no right to admission. Admission is determined by the review team on a discretionary basis, and the decision requires no statement of reasons.
4. Accuracy of Submitted Information
The applicant is responsible for ensuring that all information submitted is truthful, accurate and lawfully within the applicant's power to provide, including the rights over the photographs and documents uploaded and the consent of any identifiable person appearing in them.
Profiles may be edited for length, consistency and house style. The professional claims made within an application are not independently verified, for which reason section 6 defines the scope and the limits of inclusion.
Where information proves materially false, the Organization may decline the application, or withdraw a published profile, without prior notice.
5. Publication Licence
By giving the publication consent within the application, the applicant grants the Organization a non-exclusive, worldwide, royalty-free licence to reproduce and publish the professional information and photographs supplied, in the digital Directory and in the printed editions, and to use them in materials promoting the Directory.
The licence subsists solely for the operation and promotion of the Directory. It confers no right to sub-license that material to third parties for their own purposes. Ownership is retained by the applicant throughout, and the publication consent may be withdrawn at any time, with the effect described in the Privacy Policy.
6. Scope and Limits of Inclusion
Inclusion in WHO is WHO records that a professional has been admitted to the network by the review team. It does not constitute a governmental credential, a professional certification, an academic qualification, a licence to practise, or a warranty as to the competence, solvency or conduct of any person.
No undertaking is given that a profile will generate enquiries, clients, commercial results or any particular visibility in search engines. Members deal with one another directly and at their own risk; the Organization is not a party to what is agreed between them.
7. Conduct of Members
The declaration signed within the application commits every member to ethics, professional integrity, collaboration and mutual respect. Contact details obtained through the Directory are for professional purposes between members.
Their use for the sending of unsolicited commercial communications, for the compilation of mailing lists or for the bulk collection of data constitutes a breach of these Terms and grounds for removal. Automated extraction of the Directory — scraping, crawling for the purpose of copying, or systematic downloading of any kind — is prohibited.
8. Suspension and Removal
The Organization may suspend or withdraw a profile and revoke access to the members' area where these Terms are breached, where information proves materially false, where conduct is prejudicial to the network, or at the request of the member.
Removal takes effect within the systems of the Organization and in every subsequent edition. An edition already printed cannot be recalled.
9. Availability of the Service
The Organization endeavours to maintain the availability of the website but does not warrant uninterrupted service, and may suspend it for maintenance or on security grounds.
10. Limitation of Liability
To the extent permitted by Spanish law, the Organization shall not be liable for indirect or consequential loss, loss of profit, loss of business or loss of opportunity arising from the use of this website or from inclusion in the Directory.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for wilful misconduct.
11. Intellectual and Industrial Property
The contents of this website are protected in the terms set out in the Legal Notice. Material supplied by applicants remains the property of the applicant, subject to the licence described in section 5.
12. Modification of the Terms
These Terms may be amended. The revised version is published on this page bearing a new date. Where a modification materially affects members, notice will be given by electronic mail before it takes effect.
13. Applicable Law and Jurisdiction
These Terms are governed by Spanish law. Disputes shall be submitted to the courts and tribunals of the registered address of the operator, save where a mandatory rule of law provides otherwise.
